TERMS AND CONDITIONS OF SALE

1. PURCHASE PROPOSAL AND CONCLUSION OF THE CONTRACT

These general conditions of sale have as their object the purchase of products made remotely via the Internet network on the site www.lormar.it belonging to:

These conditions may be updated or modified at any time by Lormar S.r.l. and the consumer/purchaser agrees and undertakes to read them before placing any order.
The contract will be concluded directly through access by the consumer/purchaser to the website corresponding to the address www.lormar.it where, following the indicated procedures, he/she will arrive to formulate the proposal for the purchase of the products.
The contract is concluded with the acceptance of the order by Lormar S.r.l. and the consumer/purchaser will receive by e-mail the communication of acceptance.
All purchase orders transmitted to Lormar S.r.l. must be completed in all parts and must contain the elements necessary for the exact identification of the customer, the products ordered and the place of delivery of the goods.
By transmitting the order, the consumer/purchaser declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts the general and payment conditions. In case of non-acceptance of the order, Lormar S.r.l. will promptly notify the consumer/purchaser.
Once the online purchase proposal has been formulated, the consumer/purchaser shall print or save an electronic copy and, in any case, retain these general conditions of sale in compliance with the provisions of Legislative Decree no. 206/2005 on distance selling.
It is excluded any right of the consumer / buyer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property as a result of the non-acceptance or fulfillment, even partial, of an order. 2. SALE PRICES AND PURCHASE METHODS

Purchase proposals must be made exclusively by a person resident or domiciled in Italy, who is 18 years of age or older and in possession of a tax code/VAT number.
All sales prices of the products displayed and indicated within the website are inclusive of VAT.
The sale prices are considered valid until the communication of the acceptance of the purchase proposal. The images of the products published on the website are purely indicative. In the absence of specific indications in the order notes, the lack of conformity of the purchase cannot be complained of.
With the transmission of the purchase proposal, the consumer / buyer gives his consent to the use by Lormar and S.r.l. for distance communications, the means of telephone, electronic mail or fax.

3. METHODS OF PAYMENT

All sales prices of the Products indicated on the Site are expressed in Euros and include VAT. The prices applied are those indicated on the Site at the time of the purchase order by the Customer, without any consideration of price increases or decreases that may have occurred subsequently. The issuance of the tax document (accompanying invoice) will take place at the time the order is processed and will be shipped together with the goods.

The mode of payment is chosen by the customer between:

  • Bank transfer
    To make purchases with bank transfer payment method select the bank transfer option. Once the bank transfer is made, the order will be processed upon receipt of notification of credit to bank account. The bank details for making the payment are:

  • Cash on delivery
    Payment in cash directly to the courier at the time of consenga order. The service has an additional cost of € 5.00.

4. RIGHT OF WITHDRAWAL

The customer has the right to withdraw without penalty within 14 days from the day of receipt of the goods, by sending written notice addressed to Lormar S.r.l. Via dell'Agricoltura n. 23 - 41012 - Carpi (Mo) by registered letter with return receipt or by using the appropriate section of the website.
Lormar offers free returns on all its products.

5. PRODUCT AVAILABILITY

Should an order exceed the quantity of product in stock, Lormar S.r.l. undertakes to still guarantee the fulfillment of the order in the quantities indicated by the consumer/purchaser, ordering the missing product as soon as possible.
If the availability of the missing product is denied, Lormar S.r.l. will agree directly with him the best solution to solve the inconvenience caused.

6. MODE OF DELIVERY

Lormar S.r.l. will arrange to have the selected and ordered products delivered to consumers/purchasers by couriers and/or forwarding agents affiliated with the company.
In the event that a package arrives that is not intact or damaged or with obvious signs of tampering, it is necessary to point out the irregularity to the staff of the courier who delivers the package and sign the transport document adding the words "WITH RESERVE". This formality will allow you to protect yourself in case of any kind of anomaly found after opening the package (broken or missing pieces). In this case it will be necessary to report the incident by fax or e-mail to Lormar S.r.l.
Lormar S.r.l. must be considered exempt from any liability for loss or damage (damage) of the goods from the moment they are delivered without reserve to the courier for transport.
If a product other than the one ordered is sent to the consumer/purchaser, Lormar S.r.l. will replace the product sent erroneously with the one ordered. In this case, the consumer/purchaser must contact, within 5 days, Lormar S.r.l. by e-mail, fax or telephone notifying the incident.
Lormar S.r.l. will provide the necessary instructions for the replacement and return of the wrong product. In the event that the requested product is not available, Lormar S.r.l. will re-credit the amount paid. The wrong product must be returned intact, therefore undamaged and sealed in its original packaging, with adequate outer packaging, to prevent it from being damaged during transport. In the event that the returned product shows signs and has been opened in its packaging by cutting the original seals, the replacement process will not be activated.

7. BUYER'S OBLIGATIONS

It is strictly forbidden for the consumer / buyer to enter false and / or fictitious data in the registration procedure necessary to activate against him the process for the execution of this contract and its further communications; personal data and e-mail must be exclusively his own real personal data and not of third persons or fictitious. Lormar S.r.l. reserves the right to prosecute any violation and abuse in the interest and for the protection of all consumers.

The consumer/purchaser relieves Lormar S.r.l. from any liability arising from the issuance of incorrect tax documents due to errors related to the data provided by the consumer/purchaser being himself solely responsible for their correct entry.

8. JURISDICTION AND COMPETENT COURT

Any dispute relating to the application, execution, interpretation, and breach of the purchase contracts entered into online through the website is subject to Italian jurisdiction.
Any dispute between the parties regarding the application, execution, interpretation, and breach of this contract shall be under the exclusive jurisdiction of the Court of Modena.
